TUI flight delay compensation: claiming from TUI Airways

TUI Airways is a UK airline, so its holiday flights out of the UK and its flights home are covered by UK261. Many TUI routes are long, which can mean the top £520 rate. And TUI's former name, Thomson Airways, is on the court case that lets you claim up to six years back.

    • TUI Airways flights out of the UK and back home are covered by UK261.
    • Long-haul TUI flights (over 3,500 km): up to £520 per person.
    • Claim up to 6 years back – Dawson v Thomson Airways (2014).
    • TUI Airways is signed up to AviationADR if it rejects your claim.

    1,500 – 3,500 km£350€400
    Over 3,500 km£520€600
Per passenger, for arriving more than 3 hours late. On flights over 3,500 km, arriving 3–4 hours late halves the UK261 amount to £260 (EU261: €300).

Dawson v Thomson Airways: claim up to six years back

In 2014 the Court of Appeal decided, in a case against Thomson Airways (now TUI Airways), that in England and Wales passengers have six years to bring a delay compensation claim, not two. The Supreme Court refused Thomson's request to appeal. So a delayed TUI holiday flight from a few summers ago may still be claimable. In Scotland the limit is five years.

    How much compensation from TUI?

Some example distances on holiday routes:

    • Manchester – Palma (about 1,580 km): £350
    • Manchester – Tenerife (about 3,050 km): £350
    • London Gatwick – Hurghada (about 3,900 km): £520, or £260 if 3–4 hours late
    • Long-haul flights to the Caribbean or Mexico: £520, or £260 if 3–4 hours late

Each passenger with a paid ticket counts. A delay of 24 hours or more doesn't increase the amount – the maximum is £520 per person – but it does mean TUI must provide meals, a hotel and transport while you wait.

    TUI package holidays

If your flight was part of a TUI package, the flight compensation claim is against TUI Airways as the airline. If the delay cost you part of your holiday – a night in the hotel, a transfer, an excursion – that may be a separate claim against the tour operator under the Package Travel Regulations.

    How to claim from TUI

TUI has an online form for flight delay compensation claims. Have your booking reference, flight details and every passenger's name ready. Expenses are claimed separately with receipts.

If TUI Airways rejects your claim or hasn't given a final answer after eight weeks, you can take it to AviationADR, the alternative dispute resolution scheme TUI Airways is signed up to (according to the CAA's list, checked 2 November 2026). ADR is free for passengers.

Or send us your flight: we check it for free and deal with TUI for you. You only pay if we win.

Want to claim from TUI yourself? Start at TUI's flight delay page. Travel On Board is an independent claims service and is not connected to TUI.

    Questions people ask

No, the amount is capped at £520 per person however long the delay. But TUI must provide care – meals, a hotel and transport – while you wait.
